Many Tribal health programs, healthcare\u00a0<\/span>services<\/span>\u00a0specifically designed and\u00a0operated\u00a0by or for a federally recognized American Indian or Alaska Native tribe, are considered covered entities under HIPAA. This means they must\u00a0comply with\u00a0HIPAA\u2019s Privacy, Security, and Breach Notification Rules just like other\u00a0healthcare providers (HCPs).<\/span>\u00a0<\/span><\/p>\n For more information, review the Privacy information on the Indian Health Service (<\/span>IHS)\u00a0Website<\/span><\/a>\u00a0and the\u00a0<\/span>Breach Notification Rule<\/span><\/a>.<\/span>\u00a0<\/span><\/p>\n However, Tribal\u00a0<\/span>HCPs<\/span>\u00a0may also\u00a0operate\u00a0under\u00a0additional\u00a0Tribal data privacy policies or traditional protocols, which must be followed alongside HIPAA.\u00a0<\/span>As sovereign nations\u00a0recognized\u00a0under federal law, many Tribes\u00a0operate\u00a0their own healthcare facilities as an exercise of their sovereignty. Accessing data from these facilities requires extra care, consideration, and action to follow Tribal law and uphold sovereignty.
